Website of Legislative Affairs Office of the State Council P.R. China published Management Methods of Quarantine on Entry & Exit Traditional Chinese Medicinal Materials (Draft for Soliciting Opinions Publicly) on January 21, which plans to stipulate that the inspection and quarantine departments shall incorporate into integrity management the owners of entry & exit traditional Chinese medicinal materials or their agents as well as inbound and outbound manufacturing enterprises, and also makes clear the information reporting obligation of enterprises.
The Draft puts forward that the owners of entry & exit traditional Chinese medicinal materials or their agents as well as outbound manufacturing enterprises shall establish epidemic information reporting mechanism and emergency disposal program; shall promptly report to the inspection and quarantine departments and actively cooperate with them to handle the epidemic situation in case of discovering epidemic information.
As for acts of applying for false applications, the Draft plans to stipulate that in case that the owners of entry & exit traditional Chinese medicinal materials or their agents do not report for inspection or do not transact quarantine approval formalities or do not perform according to stipulations of quarantine approval; and the traditional Chinese medicinal materials reported for inspection are not consistent with the reality, the port animal and plant quarantine agency shall impose a fine of below 5000 yuan; in case that the quarantine certificate is obtained, it shall be revoked.
According to the Draft, in case of arbitrarily unloading of entry traditional Chinese medicinal materials from the transport machine or in case of arbitrarily transporting without approval from the inspection and quarantine departments; in case of arbitrarily removing or damaging seal or mark of animal and plant quarantine, the port animal and plant quarantine agency shall impose a fine of above 3,000 yuan and below 30,000 yuan.
